§ 1. Service provider
The website available at fufulabs.pl (the Website) is operated by FufuLabs sp. z o.o., ul. Henryka Sienkiewicza 85/87 lok. 1, 90-057 Łódź, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by Sąd Rejonowy dla Łodzi-Śródmieścia w Łodzi, XX Wydział Gospodarczy Krajowego Rejestru Sądowego, under KRS number 0001261715, NIP 7252369926, REGON 545529715 (the Service Provider or we).
These terms set out the types and scope of services provided electronically through the Website, the conditions for providing them, the conditions for concluding and terminating contracts for their provision and the complaints procedure, as required by Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
§ 2. Scope of services
Through the Website we provide two services electronically and free of charge:
- making available information about the company, its offer, terms of cooperation and its own products;
- the project form, through which you can send us a project description and contact details in order to receive questions or a proposal for scope, timing and price.
The contract for making content available is concluded when you start using the Website and terminates when you leave it. Content on the Website, including typical delivery times and the amount from which projects start, is commercial information and an invitation to talk, not an offer within the meaning of Article 66 of the Polish Civil Code. The terms of a specific project are agreed in a written contract.
§ 3. Technical requirements
To use the Website you need a device with internet access and an up-to-date web browser. The Website requires no account and no consent to cookies. To send the project form you also need JavaScript turned on in the browser, because a small program sends the submission and runs the Turnstile check that keeps bots away, plus a working e-mail address to which we will send a copy of the submission and our reply.
If the form does not work in your browser, you can send the same description as an ordinary e-mail to [email protected].
§ 4. The project form
The contract for the project form service is concluded when you send the form and expires when sending is complete, whatever its outcome; no registration and no account is required. Once the submission is accepted, the server sends a copy of its content to the e-mail address you gave, together with the date by which we will reply.
We reply to a project description within 2 working days of the day we receive it, with follow-up questions or a proposal for scope and timing. Working days are Monday to Friday. Sending a description obliges neither party to conclude a contract for the project.
You may ask for the data you sent to be deleted at any time; the rules are set out in the Privacy policy.
§ 5. Prohibited conduct
You must not provide unlawful content through the Website, in particular content that infringes the rights of third parties, is offensive or contains malicious code.
You must not disrupt the operation of the Website either, including by submitting the form by automated means, sending bulk or repeated submissions or attempting to bypass its safeguards. We technically limit the number of submissions from a single IP address and from a single e-mail address; we may leave submissions that breach this section unanswered.
§ 6. Availability and content
We make every effort to keep the content of the Website up to date: the status of our own products is marked with the time of the last check, and figures describing the products with the date on which they were counted. They may nevertheless change; only the arrangements set out in a contract are binding.
The Website may be temporarily unavailable due to maintenance or failures at infrastructure providers. We are not liable for the consequences of such an interruption to the extent permitted by law; towards consumers, we do not exclude liability that cannot be excluded.
§ 7. Complaints
We accept complaints about the operation of the Website at [email protected]. A complaint should include an e-mail address for the reply and a description of the problem, where possible with the date and the address of the page on which it occurred.
We respond within 14 days of receiving a complaint, through the same channel. Consumers may also use out-of-court complaint and redress procedures, about which the Polish Office of Competition and Consumer Protection (UOKiK) provides information at uokik.gov.pl.
§ 8. Personal data
The controller of personal data sent through the Website is the Service Provider. The purposes, legal bases, recipients, how long we keep the data and your rights are described in the Privacy policy, which forms part of these terms.
§ 9. Governing law and changes to these terms
These terms and the services provided through the Website are governed by Polish law. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence. Disputes are resolved by the court having jurisdiction under the general rules.
These terms apply from the version date shown in their header. We announce changes by publishing a new version with a new date; descriptions sent before a change are governed by the version in force on the day they were sent. These terms are published in Polish and in English; in the event of any discrepancy between the two, the Polish version prevails.
